Mayor Bloomberg: "No to Roberts"

According to the NY Times here, NY city mayor Bloomberg does not support Judge Roberts to be the Chief Justice:
In a statement handed out to reporters at City Hall yesterday, Mr. Bloomberg complimented Judge Roberts's legal knowledge and integrity but said that he was opposed to the nomination because he did not accept "the landmark Roe v. Wade ruling as settled law."
Let's just take one example of how stupid Mayor Bloomberg's rationale is - the case of Plessey v. Ferguson which upheld the concept that segregation of the races was acceptable under the theory of "separate but equal." It was the "settled law" until the Supreme Court acted in Brown v. Board of Education
The Supreme Court struck down the "separate but equal" doctrine of Plessy for public education, ruled in favor of the plaintiffs, and required the desegregation of schools across America.
Query: the Senators and mayors of the time had demanded that each nominee for the Supreme Court affirm that Plessey was "settled law" what would the status of black Americans be today if we still lived by "separate but equal?"

Oh, he has political considerations? And his logic could condemn millions to live poorer lives...

Now, tell me why Mayor Bloomberg is not a spineless idiot.
